Airbnb defeats lawsuit over unauthorized subleases

Airbnb Inc. defeated a lawsuit by Condo Funding & Administration Co., one of many largest residential landlords within the nation, alleging that the net home-sharing market permits tenants to interrupt their lease agreements via unauthorized sublets.

A federal choose in Los Angeles agreed with Airbnb that it’s insulated from the claims by the Communications Decency Act, a 1996 regulation that shields on-line service suppliers from legal responsibility for the content material customers put up.

“Right here, what allegedly makes the listings ‘illegal,’ ‘unlawful,’ or ‘offending’ is that they promote leases that violate Aimco’s lease agreements,” U.S. District Decide Dolly Gee stated in a Dec. 29 ruling.
